Having been thru the Workers' Compensation process as both an employer and employee David has a unique insight into the WorkCover process and the pitfalls and how to avoid them with the goal of achieve a positive result for all stakeholders involves.
What do we do?
We here at WCCMacarthur are a NSW WorkCover accredited Return to Work Coordinator, a RTW Coordinator's job is to help their clients manage the return to work program for any injured workers, help develop/manage/create a Return to Work Program (which is a legislatively required document for all businesses that have Workers' Compensation Insurance) and help audit companies WorkCover compliance.
Return to Work Programs
All employers must have a return to work program which consists of a formal policy and procedures to help injured workers with their recovery and with getting back to work.
It outlines your commitment to assisting injured workers to remain at work or return to work safely and as soon as possible following a workplace injury or illness.
The program must be clearly communicated to workers and provided to any worker on request. Penalties apply if you fail to do this.
Developing a Return to Work Program
If you're an employer you must develop a return to work program in consultation with workers and any union representing those workers within 12 months of becoming an employer.
If you're a category one employer (with a basic tariff premium exceeding $50,000 per annum, or self insured, or insured by a specialised insurer and employs more than 20 workers), a return to work program must be developed in accordance with our Guidelines for workplace return to work programs.
Is it worth getting a formal Return to Work Program
In short, Absolutely! According to WorkCover legislation and the Government Workers' Compensation Insurer body iCare, every employer that has a Workers' Compensation Insurance Policy MUST have a formal RTW Program that is in alignment with the employer's Workers' Compensation Insurer's Return to Work Plan/Policies/Procedures.
It is not enough to create a plan after someone is injured, and leaves an employer at risk of significant fines and substantial insurance premium increases.
Investing in a formal Return to Work Program will make you compliant, and most importantly, when / should an employee be injured and make a claim having a RTW Program in place will save you time and money, and ensure everyone has their rights and obligations preserved which will benefit everyone. Helping employee's get back to work sooner as safely possible & reduce your out of pocket expenses.
